Terms of Service

These Terms of Service ("Terms") govern your access to and use of belenos.app (the "Service"), operated by José Luis Pellicer, Spain ("we", "us", "our"). By using the Service or submitting a page for scanning, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

belenos.app is an online tool that scans a public web page you submit and processes its text content to produce a result file. We scan only the specific URL you provide; we do not crawl the target website, follow links, or access pages you did not submit. Scan results are generated automatically.

2. Eligibility

You must be at least 14 years old (the age of digital consent in Spain) and have the legal capacity to enter into these Terms. If you use the Service on behalf of an organisation, you confirm you are authorised to bind that organisation.

3. Your responsibilities and acceptable use

By submitting a page for scanning, you represent and agree that:

We may refuse, suspend, or terminate access (and cancel scans) if we reasonably believe these Terms are being violated.

4. Waiting list

If you join our waiting list, you provide your email address so we can notify you about the launch and availability of the Service. You can ask to be removed at any time. See our Privacy Policy for details.

6. Right of withdrawal (consumers) and digital-content consent

If you are a consumer in the EU, you normally have a 14-day right of withdrawal for distance contracts. However, the Service provides digital content/services supplied immediately. By purchasing and starting a scan, you expressly request immediate performance and acknowledge that you lose your right of withdrawal once the Service has been fully performed (i.e. once the scan has been carried out and the result made available). You will be asked to confirm this consent at checkout.

7. Refunds

Subject to your mandatory consumer rights and Section 6, scans are generally non-refundable once performed. If the Service fails to deliver a result due to a fault on our side, contact [email protected] and we will re-run the scan or, where appropriate, issue a refund. Nothing in these Terms limits remedies you are entitled to by law for non-conforming services.

8. Scan results — "as is"; no professional advice

Scan results are generated automatically and provided "as is" and "as available". We do not warrant that results are accurate, complete, error-free, or fit for any particular purpose, and they do not constitute legal, professional, or other advice. You are responsible for how you use the results.

We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue the Service (or any feature) at any time, including for maintenance, security, or legal reasons.

11. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or for loss of profits, data, or goodwill, arising from your use of the Service. Our total aggregate liability for any claim relating to the Service is limited to the amount you paid for the scan giving rise to the claim. Nothing in these Terms excludes or limits liability that cannot be excluded under Spanish law, including liability for fraud, gross negligence, wilful misconduct, death or personal injury, or your mandatory rights as a consumer.

12. Indemnity

You agree to indemnify and hold us harmless from any claims, damages, or costs arising from your breach of these Terms or from your submission of a page you were not entitled to scan.

13. Suspension and termination

We may suspend or terminate your access to the Service immediately if you breach these Terms or use the Service unlawfully. Provisions that by their nature should survive termination (e.g. IP, liability, indemnity, governing law) will continue to apply.

14. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date reflects the current version; material changes will be communicated through the Service. Your continued use after changes take effect constitutes acceptance.

15. Governing law and jurisdiction

These Terms are governed by the laws of Spain. Disputes will be subject to the courts of Oviedo, Asturias. If you are a consumer, this does not deprive you of the protection of mandatory provisions of the law of your country of residence, and you may bring proceedings in the courts of your domicile as provided by EU consumer law. EU consumers may also use the European Commission's Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.
